Our general Terms & Conditions for mortgage brokers

Our aim is to do everything we can to help mortgage brokers retain clients and win new business.

These terms and conditions apply to Mortgage Rewards, our website, any website operated on behalf of a mortgage broker and any associated applications or services (including emails and other forms of communication) collectively known as ‘the site’. This includes any way of accessing, browsing or downloading any part of the site.

Who we are

This site is operated by Mortgage Rewards Limited (“Us”, “We”, “Our” “Mortgage Rewards”, “Mortgage Rewards Ltd”). We are a company registered in England and Wales under company number 13665605, and our registered office is located at Sophia House, 28 Cathedral Road, Cardiff, CF11 9LJ.

We are also registered with the Information Commissioner’s Office (ICO), and our registration number is ZB297898.

Using our site

A mortgage broker (‘the broker’, ‘broker’, ‘brokers’, ‘a broker’, ‘you’, ‘your’) who licences our site, as agreed by us and at entirely our own discretion, can introduce current clients (‘clients’) who own residential mortgaged property located in the United Kingdom to our site.

A broker can also use our site to monitor their clients’ mortgage details, amend its clients’ account details and see retail rewards its clients may have accrued by activity via the site.

A broker may also receive communications from its clients via the site, including mortgage switch enquiries.

These terms and conditions (together with any documents referred to in them) explain how you may use our site.

This includes any way of accessing, browsing or downloading any part of the site. By accessing or using this site you agree to be bound by (and comply with) these terms and conditions and the documents referred to in them. If you do not agree with or accept any of these terms, you should stop using the site immediately.

Financial information disclaimer

This site provides information and comparison services in relation to particular mortgage products and services that are available from third party providers.

This site does not provide, and no information provided on this site is intended to constitute, mortgage, tax or legal advice or any other type of advice, nor does it recommend particular products or services. Professional or specialist advice should be sought before taking, or refraining from, any action on the basis of the information on this site.

Any reliance that you may place on the information on this site is at your own risk.

While we aim to keep the information on the site accurate, complete, and up-to-date, we cannot guarantee, and will not be responsible for any damage or loss related to, the accuracy, completeness or timeliness of the information.

We will give you access to our unique software, which we’ve built to help your clients pay off their mortgage faster and for brokers to retain and build relationships with clients. But we can only rely on the information you and they give us and therefore cannot warrant the accuracy of any information displayed.

Mortgage products, regardless of lender, tend to have limited availability and may be withdrawn at any time. Most of the information on our site about particular products and services is provided by third parties. In general, we act as a mere conduit for this information.

Accordingly, we will not be liable in respect of any losses you may suffer arising out of such information or any reliance you may place upon such information. Any reliance you place on such information is done so at your own risk and and you hereby acknowledge and agree that we will not be responsible, or liable to any third party, for the content or accuracy of any information or materials available on the site.

You are solely responsible for the accuracy and reliability of any information or materials uploaded by you through the site and you hereby acknowledge and agree that we will not be responsible, or liable to any third party, for the content or accuracy of any information or materials submitted by you through the site.

Please note that if you contact any client in relation to any mortgage enquiry made through the site or for any other reason, then it is your responsibility to provide them with separate terms and/or policies regarding how you process any mortgage application and such processing shall be carried out in accordance with those separate terms and/or policies (and these terms and conditions shall not apply to such further work).

Our content

The content, design, software, databases, text, graphics and all other material on the site, together with all rights of ownership therein (including intellectual property rights), is owned by us or our licensors (as applicable) and protected by copyright laws and treaties around the world. We and our licensors reserve all of our and their rights in any such materials. This means, for example, that we and they remain owners of them and free to use them as we and they see fit.

You may use the site only if you have a commercial licence with us to use the site. None of the content, design, software, text, graphics or other material used on the site may be reproduced, modified or redistributed without our prior and explicit written permission. You must not use this site for any commercial purpose without our express written consent.

We do not make any recommendation or endorsement as to any experts, investments or to any content submitted by third parties or linked to our site. Any reliance you place on content is done at your own risk.

Limitations and exclusions of liability

Nothing in these terms and conditions will:

- Limit or exclude our or your liability for death or personal injury resulting from negligence;

- Limit or exclude our or your liability for fraud or fraudulent misrepresentation;

- Limit any of our or your liabilities in any way that is not permitted under applicable law; or

- Exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this section and elsewhere in these terms and conditions:

- Are subject to the preceding paragraph; and

- Govern all liabilities arising under the terms and conditions or in relation to the subject matter of the terms and conditions, including liabilities arising in contract, in tort (including negligence), and for breach of statutory duty.

We will not be liable for any loss or damage of any nature arising out of or in connection with the site or your use of the site.

We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

We will not be liable to you in respect of any loss or corruption of any data, database or software.

We will not be liable to you in respect of any special, indirect or consequential loss or damage.

You accept that we have an interest in limiting the personal liability of our officers and employees.

Having regard to that interest, you accept that we are a limited liability entity and agree that you will not bring any claim personally against individual officers or employees in respect of any losses you suffer in connection with the site or these terms and conditions. This will not, of course, limit or exclude the liability of the company itself for the acts and omissions of our officers and employees.

While we try to make sure that the site is available for your use, we do not give any guarantee that the site will be available at all times, nor do we guarantee that access to the site or its content will be free from errors and uninterrupted.

Viruses

We do not guarantee that the site, or its content, will be secure or free from bugs, viruses or anything else that may be considered harmful. It is your responsibility to put the necessary safeguards in place to protect yourself and your technology.

You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.

You must not attempt to gain unauthorised access to the site, the server on which the site is stored or any server, computer or database connected to the site.

You must not attack the site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the site will cease immediately.

We will not be liable for any loss or damage caused by a virus or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site or to your downloading of any content on it, or on any site linked to it.

Setting up an account

Certain parts of our site may require an Account in order to access them. You may not create an account if you are under 18 years of age.

During registration, the information you provide must be accurate to the best of your knowledge. 

If any of your information changes at a later date, it is your responsibility to ensure that your account is kept up to date.

If you choose (or you are provided with) a user identification code, password or any other piece of information as part of our security procedures during registration, you must treat such information as confidential. If you fail to keep any information confidential, you are entirely responsible for any consequences stemming from such failure.

Account security and use

You must notify us immediately if you suspect or become aware that the confidentiality of your account has been compromised.

We reserve the right to terminate your account if:

- More than one person is using your account;

- Somebody else is using your account;

- You are breaching these terms and conditions (or our Privacy Policy);

- You have provided false or incorrect information at the time of registration;

- Your licence to use our site has been terminated for any reason;

Account closure and deletion

The closure of your account will result in the removal of your account data. It will also remove access to any areas of the site requiring an account. On closure of your account, any client information, content, reward data and reward balances will be retained by us and we reserve the right to use this information as per our user Terms and Conditions and Privacy Policy.

Please be sure to keep your account up to date with your current email address to make sure you don’t miss out on any important information about your account. If we don’t have a serviceable email address or if you mark our emails as spam, junk or abusive, we may terminate your account.

You can manage your account within your account profile. You can subscribe to or unsubscribe from any emails we may send, although please note that you cannot unsubscribe to service emails which we deem to be essential in order to use the site.

Please make yourself familiar with the email section in our Privacy Policy and feel free to amend your account settings to reflect what information you would like to receive from us.

You agree to ensure your username on the site is not offensive nor used in any way which may represent any trademarks or brand names. If we detect any usernames contravening this provision we shall contact you and request that you update this. Failure by you to respond within 14 days may result in your account being terminated.

Our site is only for clients who own a mortgaged property (or properties) in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.

Links to third party retailers and companies appear on the site. Such third party sites are not the responsibility of Mortgage Rewards Ltd and we accept no responsibility for the availability, suitability, reliability or content of such third party sites and do not necessarily endorse the views expressed within them. We will not be liable for any loss or damage that may arise from your use of them.

Third party sites may collect and treat information they collect differently, so we encourage you to carefully read and review the Terms & Conditions and Privacy Policy for each site you visit.

You are solely responsible for your interactions with all clients. You hereby release us from any and all claims or liability related to any interactions you have with clients.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of any third party site linked to our site.

How client information is used

We fully respect the information you provide to us about your clients (for example, their personal information and information about their mortgage).

We will never use this information to offer our own mortgage or protection advice, and we will never sell or disclose this information to any third party.

For the avoidance of doubt, we only use client information to communicate rewards data (for example, confirmed/pending cashback balances), and to provide useful mortgage-related information and automated switch alerts.

Acceptable Use Policy

You may link to our site as agreed in advance by us, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. We reserve the right to withdraw linking permission without notice.

You must not link a site to us which we may deem at our sole discretion to be inappropriate, contain explicit material, immoral or offensive.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Our site must not be framed on any other site.

You must not redirect other domain names to our site.

We do not warrant or guarantee that our site will be secure or free from bugs or viruses and shall not be held liable for any loss, damage or disruption you may suffer whilst using material derived from the site.

You are responsible for configuring your information technology, computer programmes and platform to access our site, and you should use your own virus protection software.

We cannot verify the accuracy or otherwise of any comments or messages transmitted between you and clients and we are not responsible or liable for any such comments, reviews or responses. You acknowledge we are not responsible for checking the identity, or for the behaviour, of clients.

We reserve the right to remove any comments or reviews at our discretion.

We reserve the right to suspend any broker’s access to the site that violates these terms and conditions or who engages in offensive and detrimental behaviour, including behaviour that shocks, insults, or offends public morals and decency, including through making racist, discriminatory or offensive comments or by taking actions that are not in keeping with our Terms and Conditions.

Privacy

We take your privacy very seriously. Please take the time to familiarise yourself with our Privacy Policy to understand how we treat your personal information and your own responsibilities in relation to your information and account.

Amendments

From time to time we may update our Terms & Conditions by posting a revised version on our site. These terms were last updated on the 21st of March 2022.

We recommend that you regularly check the Terms & Conditions on the site to ensure that you are informed of, and happy with, these terms and any amendments to them.

Continued use of the site after the Terms & Conditions have been revised will constitute your acceptance of, and your agreement to be bound by, these revised Terms & Conditions.

Severability

If any provision detailed in these Terms & Conditions is deemed unlawful, invalid or unenforceable that provision will be deemed severed from the remainder and the validity and enforceability of the remaining provisions will not be affected.

Assignment

You hereby agree that we may assign, transfer, subcontract or otherwise deal with our rights and/or obligations under these Terms & Conditions without notifying you or obtaining your specific consent.

Governing law and jurisdiction

These terms and conditions, their subject matter and formation are governed by English & Welsh law.

Any disputes under or relating to these Terms & Conditions and/or the site will be subject to the exclusive jurisdiction of the English & Welsh courts.

If you use the site to contact any client or third party or introduce any client to the site, you acknowledge and agree that you will ensure you comply with all applicable laws and requirements for user privacy, including the Data Protection Act 2018 and the Privacy and Electronic Communications (EC Directive) Regulations 2003, as amended from time to time, and all other applicable privacy and data protection laws and regulations, as well as any guidance and/or codes of practice issued from time to time by the UK Information Commissioner. Email newsletter and alerts

This site also operates an additional email newsletter and alert program, used to inform you about products and services supplied by this site. Users can subscribe through an online automated process should they wish to do so but do so at their own discretion.

We may subscribe you to our email newsletter and alert program manually, but only:

- If this was made clear to you and your express permission was granted when submitting your information to us; or

- Where you have previously purchased, or enquired about purchasing, from us a product or service that the email newsletter relates to.

This is by no means an entire list of your user rights in regard to receiving email marketing material.

Subscriptions are taken in compliance with anti-spam laws detailed in the Privacy and Electronic Communications Regulations 2003. All personal details relating to subscriptions are held securely and in accordance with the Data Protection Act 2018. No personal details are passed on to third parties, nor shared with companies/people outside of the company that operates this site.

Email marketing campaigns published by us may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in a database for future analysis and evaluation. Such tracked activity may include; the opening of emails, forwarding of emails, the clicking of links within the email content, and the times, dates and frequency of activity.

This is not an exhaustive list and we may use other tracking activities relating to email marketing campaigns in accordance with this policy. The information we track and store is used to refine future email campaigns and supply the user with more relevant content based around their activity.

In compliance with anti-spam laws and the Privacy and Electronic Communications Regulations 2003 subscribers are given the opportunity to unsubscribe at any time through an automated system. This process is detailed at the footer of each email campaign. If an automated unsubscription system is unavailable, clear instructions on how to unsubscribe will be detailed instead.

From time to time we may give you the option to publish content to or through the site, including in blog comments, reviews and testimonials.

We may wish to publish or re-publish such user content on the site and shall have the right to do so subject to this policy.

Users are advised to use social media platforms wisely and communicate/engage upon them with due care and caution in regard to their own privacy and personal details. We will ever ask for personal or sensitive information through social media platforms and encourage users wishing to discuss sensitive details to contact us through primary communication channels such as by telephone or email.

This site may use social sharing buttons which help share web content directly from web pages to the social media platform in question. Users are advised before using such social sharing buttons that they do so at their own discretion and note that the social media platform may track and save your request to share a web page respectively through your social media platform account.

Shortened social media links

We may share web links to relevant web pages through our social media platform accounts. By default, some social media platforms shorten lengthy URLs/web addresses.

Users are advised to take caution and exercise good judgement before clicking any shortened URLs published on social media platforms by us. Despite the best efforts to ensure only genuine URLs are published, many social media platforms are prone to spam and hacking and therefore we cannot be held liable for any damages or implications caused by visiting any shortened links.

Overseas transfers

The Information you provide may be transferred to countries outside the European Economic Area (EEA) that do not have similar protections in place regarding your data and restrictions on its use as set out in this policy. However, we will take steps to ensure adequate protections are in place to ensure the security of your information. The EEA comprises the European Union (EU) member states plus Norway, Iceland and Liechtenstein. By submitting your information you consent to these transfers for the purposes specified in this policy.

Your rights

Under the Data Protection Act 2018 you may request a copy of personal information we hold about you. A small fee will be payable. If you would like a copy of the information held on you please write to the business address at the bottom of this policy.
